How to donate house to children?
Tax of transaction is zero if the donor is the owner of the house and it is the family home (inhabited by the donor's family, the donor need not be the principal inhabited)
If the home is mortgaged, the new owner of the home must be approved by the bank.
The new owner only need to pay notary costs.
The Will - witnesses must be people unrelated to the giver and to the recipient. Donor and new owner must be in full mental authority at the time of signing.
It is possible to add additional transaction conditions in the land and mortgage registers, e.g. residence, pre-emptive rights, etc.
Public Trustee is an institution that does not exist in Poland. When someone is incapacitated or dies, but does not have a family, this institution takes over the care of the house. The Public Trustee manages the finances of the incapacitated person, but charges a fee of 20% of the transaction.
